expressly acknowledge and understand that participation in the 2009 College Beer Pong Championship Activities at the Silver Legacy Hotel/Casino or Eldorado Hotel/Casio or other location (collectively referred to as "the activities") pose risks of injury or death or property damage/loss. Despite the risks involved, and in consideration of the right to participate in the activities, I AGREE TO EXPRESSLY ASSUME ALL RISKS OF INJURY OR DEATH OR PROPERTY DAMAGE/LOSS that might be associated with my participation in the activities and use of the facilities. Silver Legacy Hotel/Casino, Eldorado Hotel/Casino, or other location for the event activities are collectively referred to as "use of the facilities."

I understand that the activities occur in facilities that are located miles away from hospital or medical facilities. As a result, medical assistance may not be immediately available. I agree to assume the risks of injury or death or property damage posed by participation in the activities in or at the facilities.

As consideration for being permitted to participate in these activities, I AGREE NEVER TO SUE, AND TO RELEASE FROM ANY LIABILITY OR CLAIMS, CAUSES OF ACTION, AND TO INDEMNIFY, DEFEND AND HOLD HARMLESS THE FOLLOWING: College Beer Pong Championship LLC, a Nevada limited liability company, Sean Nelson, Silver Legacy Hotel/Casino, Eldorado Hotel/Casino, their owners, investors, officers, directors, managers, managing agents, registered agents, employees, agents, landowners, and all affiliated companies (collectively referred to as "the released and indemnified parties"), for injury or death or property damage/loss resulting from my participation in the activities or use of the facilities, regardless of the cause, including the alleged NEGLIGENCE of College Beer Pong Championship LLC, and the other released parties.

I UNDERSTAND THAT THIS IS A RELEASE OF LIABILITY THAT IS VALID FOREVER, and that it will prevent me and my heirs from filing suit or any action or making any claim for damages in the event of injury or death or property damage/loss to me arising out of my participation in the activities or use of the facilities. In the event I or any other person acting on my behalf files a lawsuit or other action arising our of my participation in the activities or use of the facilities, I AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS the released and indemnified parties for any damages, attorney fees or costs associated with or arising out of such a lawsuit or other action. I also agree to indemnify the released and indemnified parties for any and all claims brought by a third party which arise from the participant's or my participation in the activities.

I EXPRESSLY REPRESENT THAT I AM AT LEAST EIGHTEEN (18) YEARS OF AGE AND POSSESS THE FULL LEGAL AND MENTAL CAPACITY TO EXECUTE THIS RELEASE AND INDEMNITY AGREEMENT AND TO PARTICIPATE IN THE ACTIVITIES IN THE FACILITIES.

I EXPRESSLY AGREE AND REPRESENT THAT I WILL NOT COMMIT, OR ALLOW ANYONE WITH WHOM I AM AFFILIATED OR ASSOCIATED IN ANY MANNER, TO COMMIT DAMAGE, INJURY OR WASTE TO ANY OF THE FACILITIES OR EQUIPMENT OR PROPERTY LOCATED THEREIN OR USED IN THE ACTIVITIES IN ANY MANNER. IN THE EVENT OF ANY SUCH DAMAGE, INJURY OR WASTE I AGREE TO IMMEDIATELY PAY TO COLLEGE BEER PONG CHAMPIONSHIP, LLC THE FULL REPLACEMENT VALUE OR COST OF REPAIR, WHICHEVER IS GREATER, FOR ANY SUCH DAMAGE, INJURY OR WASTE.

I further agree that I will strictly obey all laws, rules or regulations associated in any manner with the activities and the facilities.

I grant exclusive permission to the released and indemnified parties and their authorized agents to use my name, likeness, and photograph for the purpose of publicity, public relations, editorial, or other advertising purposes without restriction.

I further expressly agree and acknowledge that I understand that the prize offered for the wining team in this activity is strictly based on the number of registered and fully paid teams participating in the activity. The prize for the wining team is established as follows:
1 to 199 teams registered and paid: $1,000.00;
200 to 299 teams registered and paid: $2,000.00;
300 to 399 teams registered and paid: $3,000.00;
400 to 499 teams registered and paid: $4,000.00;
500 to 599 teams registered and paid: $5,000.00;
600 to 1,000 teams registered and paid: $10,000.00

I understand and agree that this agreement is severable and that if any clause is found to be invalid, the balance of the contract will remain in effect and will be valid and enforceable. I agree that any action will be brought in the County of Washoe, State of Nevada. This agreement will be governed and interpreted by the laws of the State of Nevada. Any disputes will be subject to and determined under the laws of the State of Nevada.

THIS IS A RELEASE OF LIABILITY. READ AND UNDERSTAND IT BEFORE SIGNING.

Applicants under the age of 18 are required to have a parent or legal guardian read and sign, verifying that parent/guardian may sign this agreement on the minor's behalf and that both parent/guardian and applicant have read and understand the terms of this agreement and will be bound by its terms.
